Entry. The prizes that may be awarded to the eligible winner(s) are not transferable, redeemable for cash, or exchangeable for any other prize(s). Participants must provide valid and accurate contact information. If a winner cannot be contacted or is disqualified for any reason in the sole discretion of the University of Arkansas (“UA”), UA reserves the right to determine, in its sole discretion, an alternate winner or not to award any particular prize. All blanks must be filled in accurately or entry may be considered in eligible.
Eligibility and Limitations. Participants must be persons, not corporate or other legal entities. Participants must also be US residents. Participants may enter as many times as allowed by the host website. Only one (1) prize per household for the contest will be awarded to the winner(s). A parent or guardian of any participant who is a minor must sign a release on behalf of the minor to be eligible to receive a prize, but UA reserves the right to refuse to award a prize to or on behalf of the minor. Employees of UA, the UA’s participating sponsors, their advertising agencies, and members of the immediate family of any such persons are not eligible to participate in the contest or win any prizes(s). The term “immediate family” includes spouses, siblings, parents, children, grandparents, and grandchildren, whether as in-laws or buy current or past marriages, remarriages, adoption, cohabitation or other family extension, and any other persons residing at the same household whether or not related.
Taxes. Any evaluation of the prize(s) offered by UA is based on available information provided to UA, and the value of any prize awarded to a winner may be reported for tax purposes as required by applicable law. Each winner is solely responsible for reporting and paying any and all applicable taxes related to the prizes and paying any expenses associated with any prize which is not specifically provided for in the official rules. Each winner must provide UA with valid identification and a valid taxpayer identification number or Social Security number before any prize will be awarded. Any person winning any prizes from UA valued over $600 will receive an IRS Form 1099 at the end of the calendar year and a copy of such form will be filed with the IRS.
Publicity. By participating in this contest, Participants grant UA irrevocable and exclusive permission to use their names, characters, entries, photographs, voices, videotape, and likenesses in connection with any promotion of this and other contests or promotions, and waive any claims to royalties, rights, or remuneration by such use. By participating in the contest, where allowed by law, Participants agree that UA may disclose personal information obtained from Participants in the contest to third parties and use such information for marketing and other purposes.
Disqualification. Failure to comply with any published contest rules is grounds for immediate disqualification from the contest. UA reserves the right to disqualify any Participant or entry not conforming to the rules of the promotion at any time. UA, its sponsors, and its contest and promotional partners assume no responsibility for entry fraud committed by the Participant. In the event it is determined, in UA’s sole discretion, that Participant is ineligible and Participant wins the contest or a prize, UA reserves all rights to the ownership in return of the prize and all costs associated with remedying any prize award to any in eligible entry or Participant.
Compliance with UA Policies and the Law. UA will interpret these rules and resolve any disputes conflicting claims or ambiguities concerning the rules or the contest and UA decisions concerning such dispute shall be final. If the conduct or outcome of the contest is affected by human error, any mechanical malfunction or failures of any kind, intentional interference or any event beyond the control of UA, UA reserves the right to terminate this contest, withhold any prizes, substitute any prize, or make such other decisions regarding the outcome as UA deems appropriate. All decisions related to this contest will be made by UA and will be final. UA may waive any of these rules, at any time, at its sole discretion.
Participants agree to fully comply with all applicable UA policies, federal, state and local laws, ordinances, and regulations. Participants further acknowledge and agree that UA is a Division I member of the National Collegiate Athletic Association (“NCAA”), as well as the Southeastern Conference (“SEC”), and that UA is subject to all bylaws, rules, and regulations of the NCAA and SEC. Accordingly, Participants agree that they will fully comply with all NCAA and SEC bylaws, rules, and regulations. Participants will hold harmless and indemnify UA against any and all claims by third parties for any violation of such policies, bylaws, rules, regulations or laws by Participant or any of his/her agents, immediate family members, guests or invitees.
Participants irrevocably and unconditionally agree that any legal proceeding against UA shall be brought in the State of Arkansas’ administrative or judicial forums, and the place of execution for this contest, the award of prizes, and any and all related activities and representations, shall be the State of Arkansas, and shall be subject to its sole jurisdiction and governed by, construed and enforced pursuant to the laws of the State of Arkansas without regard to its choice of law principles (including without limitation any and all disputes, claims, counterclaims, causes of action, suits, rights, remedies, promises, obligations, demands, and/or defenses related thereto that may be asserted by either party).
Participants acknowledge that UA is an entity of the State of Arkansas. Participants agree that all claims, demands or actions for loss, expense, damage, liability or other relief, either at law or in equity, permitted by law, for actual or alleged personal injuries or property damage arising out of or related to this contest or the award of prizes, or any performance and transaction contemplated hereby, shall be filed in the Circuit Court of Washington County, Arkansas, if at all, and further waive and agree not to plead or assert that any claim, action, suit or proceeding has been brought in an inconvenient forum. Nothing contained in these rules shall be deemed, construed or operate as a waiver of any immunities to suit available to UA and/or its trustees, officials, employees, volunteers, students, agents or representatives (in both their official and individual capacities) or their right to assert in good faith all claims and defenses available to them in any proceeding.
No Liability. By participating in the contest, each Participant releases and waves any and all claims or causes of action of any kind against the NCAA, SEC, ESPN, the UA, and their respective trustees, officers, employees, volunteers, subcontractors, and agents, the contest sponsors, website host, and their respective employees and agents (“Releasees”), including any claims or causes of action for personal injury or loss which may occur from the conduct of, or participation in, the contest or from the use of any website, receipt of any prize, or related to any activities associated with the prize offered or received. In order to receive a prize, each winning Participant must sign the official waiver form provided by the UA. PARTICIPANTS UNDERSTAND AND AGREE THAT NO RELEASEE SHALL NOT BE LIABLE FOR ANY ATTORNEYS’ FEES OR COSTS, DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, EXEMPLARY DAMAGES OR OTHER DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, BUSINESS OPPORTUNITY, GOODWILL, PERSONALITY RIGHTS, MENTAL ANGUISH OR OTHER LOSSES (REGARDLESS OF THE NOTICE OF THE POSSIBILITY OF ANY DAMAGES) ARISING FROM OR RELATED IN ANY WAY.
Miscellaneous. This contest is offered by the UA, is void where prohibited, and is not associated with any other entity, contest, offer, award, promotion, sweepstakes, or prize. UA shall not be deemed to have entered into any partnership or joint venture relationship with any third party or website host. The odds of winning depend upon the number of Participants. Each winner must submit proof of eligibility and sign UA’s release form to claim a prize. UA may substitute prizes, amend the rules or discontinue the contest at any time as announced, for any reason. UA disclaims any responsibility to notify Participants of any aspect related to the conduct of the contest or the award of prizes.
